eBay Sales Tax 

eBay is considered a marketplace facilitator, which means that they collect and remit sales taxes to most states. The seller is not liable to collect and remit sales tax for those states.

Marketplace Responsibility

eBay is considered a marketplace facilitator. This means that for certain states, eBay collects and remits sales tax on behalf of sellers. If the shipping address for the transaction is in a state with a marketplace facilitator law then eBay will handle the sales tax for that transaction. The seller does not need to remit the taxes collected for those transactions.

Seller Responsibility 

If the shipping address for a transaction isn’t in a state with a marketplace facilitator law then the responsibility to collect and remit the sales tax falls on the seller. There are tools available to include applicable sales taxes at checkout on eBay. Consult with us for assistance with determining your sales tax liability and setting up sales tax collection on eBay.

What if I Sell on Another Platform?

A seller may have no liability to collect and remit sales tax on eBay or Amazon because both platforms are considered marketplace facilitators. However, if that online retailer also sells on another platform that is not a marketplace facilitator, such as Shopify, then they are liable to collect and remit sales tax for those transactions.

Sales Tax Exemptions

Many companies and groups qualify as exempt from sales tax and may make purchases on eBay without paying sales tax. For transactions like this it is important to collect the exemption certificate from the buyer in order to verify their exemption status. We recommend keeping exemption certificates on file for a minimum of 5 years from the transaction date. In the case of an audit, an auditor may ask for proof of exemptions when a sales tax exempt transaction is in question. Without the exemption certificate the seller may be liable for the sales tax they did not collect.

The State of Alabama has a program for simplified sellers use tax (SSUT) under Statute § 40-23-192. eBay has collected simplified sellers use tax on taxable transactions delivered into Alabama and the tax of flat eight percent (8%) will be remitted on the customer’s behalf to the Alabama Department of Revenue.

City and County of Honolulu Bicycle Registration Fee
All bicycles in the City and County of Honolulu with 20″ or larger wheels are required to be registered. There is a one-time registration fee of $15, and a fee of $5 when transferring ownership of a bicycle. eBay is not collecting bicycle registration fees on behalf of sellers. Buyers should register their bicycles at the main bicycle registration station or by mail, administered by the Department of Customer Services (CSD). Each jurisdiction has a website with a portal that taxpayers can access to file their returns online and view account details. We’ll get these accounts setup for you if you don’t already have active accounts. 

If you already have active eFile account, then we will request access to them so we may file and pay returns on your behalf. Our professional sales tax team will be with you every step of the way.

Obtain Sales Data 

We need access to sales data in order to prepare and file sales tax returns. We can access this in a variety of ways – whichever is most convenient and affordable to you. We have experience with many different platforms so we can create a custom solution that fits your business needs.

Once access to sales data is setup then the sales tax process is pretty much streamlined. We will gather the data monthly and file returns on your behalf. All you need to do is watch for our emails with the monthly reports that detail the amount of sales tax expected to be paid out that month.

Prepare Return

We prepare your return for you so this step is all us. We’ll prepare your tax return and any necessary additional forms using the information you provided to us. We may reach out to you for additional information if anything is missing.

Sign and File!

Once your return is complete we will file the return and remit the payment due. Towards the end of each month we will email a filing confirmation report that will detail the exact amounts paid to each state/locality. We also include copies of all of the returns filed for you records.
