Mark Your Calendars: The Complete Guide to 2024 Sales Tax Holidays

With the arrival of the New Year, it’s time for businesses to prepare for sales tax in 2024. Some laws stay the same on an annual basis, while others are being constantly reevaluated and updated. Amidst all the obligations, sales tax holidays can be an afterthought for many business owners. To help you keep track of what sales tax holidays might apply to your business in 2024, we’ve created this article.

Note: many states have not yet finalized the dates for their sales tax holidays this year, and more may continue to pop up as time goes on. Keep this article handy for updates whenever new holidays and dates are announced.

What are Sales Tax Holidays?

Sales tax holidays are periods of time when qualifying items are exempt from sales tax. They occur annually in many U.S. states, usually lasting between 1-4 days. However, some can span over two weeks and even a year!

From 12:01 am on the start date to 11:59 pm on the end date, these tax free periods are meant to provide relief to consumers by temporarily lowering prices on items like clothing, school supplies, computers, hurricane preparedness items, and more. Retailers, whether the brick-and-mortar type or online, are required to participate and must have a way to identify exempt items at checkout.

Retailer Compliance

Each state with sales tax holidays have different rules, but there is some common crossover between them. Understanding how these holidays relate can be an effective way for retailers to stay on top of compliance. Keep these common sales tax holiday themes in mind as you strive for better sales tax understanding for your business in 2024.

Weekends and School Preparation

Most sales tax holidays occur during weekends and are primarily targeted toward school preparation. Several states schedule their tax-free weekends in late July or early August, when children and parents are preparing for a new school year. Be aware of this trend and how it often includes items such as clothing, computers and computer software, books, and other educational supplies used in a classroom.

Dollar Amounts

The tax-free status during sales tax holidays typically applies to items below a certain dollar amount. This limit varies by state. Generally, more expensive items in their category are less likely to be excluded from tax. Additionally, these dollar thresholds are often per item rather than the purchase as a whole. For example, if a single article of clothing is under $100, then a $400 dollar purchase of four or more pieces of clothing will be tax-free.

Product Type

Typically, specific types or brands of products are exempt from sales tax during these holidays. Very few states allow almost all retail purchases under a certain amount to be tax-free. The most common type of products that are a part of sales tax holidays include:

  • Clothing
  • School supplies
  • Footwear
  • Computers and computer software
  • ENERGY STAR-labeled products
  • WaterSense-labeled products
  • Other energy efficient appliances
  • Emergency preparedness supplies
  • Generators

State and Local Requirements

States usually dictate the overarching rules for sales tax holidays, but local jurisdictions are sometimes allowed to opt out of tax-free periods if they choose. In these cases, items will be exempt from state tax rates but will still have local rates attached.

Brick-and-Mortar plus Online Retailers

In almost every state, sales tax holidays apply to both brick-and-mortar and online retailers. However, the criteria for online purchases can be a little more complicated. In most states, if a non-taxable item is purchased online and paid for during the holiday, it is tax-exempt even if it is delivered after the holiday ends. On the other hand, if an item is paid for before the holiday begins but delivered to the customer on a tax-exempt day, the tax still applies. Additionally, shipping and handling charges that are separately stated can be taxed.

Personal vs. Business Use

With few exceptions, states limit sales tax holiday eligibility to purchases that are made for personal use. Qualifying items bought by businesses for the use of business, trade, or otherwise are still taxed.
